Comedian, actor and high-stakes poker dabbler Kevin Hart is being sued for million by a woman for a 2017 sex tape that was filmed in a Las Vegas Strip casino.

Montia Sabbag, who met Hart at the Marquee nightclub at the Cosmopolitan, is alleging that while the sex was consensual, the filming was not. Her lawsuit claims that the filming of the encounter, which took place later that night in a Cosmopolitan Hotel suite, was a premeditated plan by Hart and J.T. Jackson, a friend of Hart.

Jackson was arrested on two counts of extortion soon after the release of the tape more than two years ago. Initially, when the situation first broke, Sabbag claimed that Hart was a victim as well and she had no intention of suing him. Instead, she went to the cops in hopes of bringing the perpetrator to justice.

Now, she’s claiming that Hart was part of the plan and is going after eight-figures in damages. Sabbag says that with Hart’s upcoming comedy tour, the press that he received from the leak of the tapes, was motivation for allowing Jackson into the room, placing cameras around the room, and secretly filming the affair.

Jackson said that he never extorted the comedian and in Hart’s apology video, he said nobody should profit off of the tapes.

Hart is a semi-active member of the high-stakes poker community. He lost a high-profile boxing match bet against poker pro Antonio Esfandiari last spring, and has participated in a couple of poker tournaments with six-figure buy-ins over the last few years.

The Cosmopolitan has a history of being the center of controversy. In May, Rapper Meek Mill was denied entry to the Strip casino.
